    Body Corporate

    The Body Corporate is a legal entity created when land is sub-divided and registered to establish a Strata Title. These are for apartment blocks, townhouses etc. As soon as you become an owner of property in an aapartment block or a townhouse, you automatically become a member of the Body Corporate. The Body Corporate is created to manage the issues of necessary and mutual interest of each property owner in the multi-dwelling unit. Body Corporates are managed by a committee representing each property owner and made up of property owners and financed by Body Corporate fees which are shared by the property owners.

    Caveat

    Essentially, a caveat is a written warning within the certificate of title that there is a third party with financial or beneficial interests attached to the property. At times there can be many caveats attached to the certificte of title.

    Covenant

    A covenant is a rule or set of rules attached to a property. You might say that they are a set of restrictions. The covenant will tell you what you can and cannot do with regards to changes on the property. Parts of covenants can be removed, but you will have to take legal steps with a solicitor and even then there is no guarantee that it will be successful.

    Disbursement

  • Disbursements (Conveyancing fees) are fixed costs incurred by your conveyancer on your behalf to pay fees such as statuatory searches.
  • Dispursement Statement of Adjustment - When a final adjustment of costs to be incurred and/or shared by the vendor and/or Purchaser such as council rates or local water authority costs.
  • Easement

    An easement is the right to use a part of your land owned by someone else (a person or an organization). Its important to be aware about easements as you are not allowed to prevent access to them in the event that they need to be accessed.

    Section 32

    A Section 32 (Vendors Statement) is a document that you should receive from the property vendor. It is important to note that you must not sign any contracts until you have received the Section 32.

    Stamp Duty

    Stamp Duty is a tax levied by the State Government on land or property transactions. Stamp Duty is calculated on the value of the land or property. The easiest and most accurate means of calculating property Stamp Duty is to visit the State Revenue Office of Victoria Victorian Stamp Duty Calculator (Provided by State Revenue Office of Victoria)

    Strata Title or Community Titles Scheme

    A Strata Title or Community Title Scheme is the title given for a multi-dwelling unit or property such as an apartment or townhouse. Strata titles can be based on size of the apartment as compared to other apartments in the building. Strata titles differ from normal titles as they also include common areas such as corridors, gardens, driveways which are managed by a body corporate.

    Three day cooling off period

    The Purchaser has the right to cancel the contract of sale within three business days of signing. It is important to note that the three days begins when the Purchaser signs the contract, not when the Vendor signs the contract, i.e. The Vendor signs three business days after the Purchaser, the three day cooling off period will not apply. There are some further restrictions to be aware of however.

  • It must be residential land or a residential property.
  • If the Vendor and Purchaser have already entered into a three day cooling off period on the same land or property previously, the Purchaser cannot re-enter into a further three day cooling off period.
  • A three day cooling off period will not apply if the Purchaser is a real estate agent or corporate body.
  • If a private sale has taken place at or within three business days of an advertised auction for the land or property, a three day cooling off period will not apply.
